How to Do Probate Without a Will

Finding yourself responsible for someone’s estate when they left no will is a common situation. But you can still do probate without a will. This guide walks you through how.

First: make sure there really is no will

Before assuming there is no will, carry out a thorough search:

  • The deceased’s home, including document files, filing cabinets, and lockboxes
  • Their solicitor’s office (call any firm they may have used)
  • Their bank, which may hold a copy
  • The National Will Register at Certainty.co.uk
  • The Probate Service’s will storage (a certificate of deposit would have been issued)

Only once you have exhausted every reasonable search should you proceed on the basis that no will exists.

What happens to the estate without a will?

When someone dies without a valid will, the Rules of Intestacy set out who is entitled to inherit. Broadly, the estate passes first to a surviving spouse or civil partner, then to children, then to other relatives in a defined order. Unmarried partners have no automatic entitlement. Neither do stepchildren unless formally adopted.

Who applies for probate without a will?

Without a will, there is no named executor. Instead, a close relative can apply to become the administrator of the estate. The order of priority broadly follows the intestacy rules: surviving spouse or civil partner first, then children, then other relatives.

How does the application process differ?

Instead of form PA1P (used when there is a will), you complete form PA1A, the probate application form for intestacy cases. You submit it to the Probate Registry along with the relevant HMRC IHT forms, certified copies of the death certificate, and the £526 Probate Registry fee.

How YouCanDoProbate handles intestacy cases

YouCanDoProbate is equally effective for estates with and without a will. The platform’s Intestacy Walkthrough guides you through the family circumstances step by step, confirms who is entitled to what under the Rules of Intestacy, and uses those answers to complete the PA1A and all required HMRC forms automatically.

Probate application

Although my application was fairly straightforward at my age I needed it to be stress free. The help I received and the clear instructions and information made it just that.

Extremely helpful

Extremely helpful, friendly and super fast. I went to several solicitors and companies that offer probate – they were all so expensive. YOU DON’T NEED ANYONE. This is an amazing, user friendly system with as much support as you need. Highly reecommended.

The process from start to finish was so…

The process from start to finish was so easy and the site actually walks you through everything you need to do, it only brings up the forms that are relevant to your probate claim and even self populates them for you, all this and at a fraction of the cost of employing the services of a solicitor. I would not hesitate in recommending them to anyone.

Straightforward and easy to use

Straightforward and easy to use, I’d recommend this to anyone. I’ve had to apply for probate on an estate with various investments, property and outstanding tax. I entered all information over a couple of days, prompted by they software. I think it would be hard to go wrong. I had questions answered very quickly either by phone or email. There was a slight glitch which resulted in incorrect tax form generation. I sent a query in on a service ticket and got a phone call over a weekend that resolved everything. My IHT400 and Probate were accepted and granted straight away. Providing you have all information about the estate to hand, this makes it very easy. Well worth the money. Thanks.

I found it very helpful but of special note is the fact you can call their helpline for assistance which I did on a few occasions. They were always very patient and solved my issues.

From the beginning I have had helpful advice. Tom has shown oodles of patience. My hearing is not of the best, neither is my eyesight, but I plodded on with his gentle pushing. I have not finished yet, a paper has gone missing which will hold up the finish for a few days. Which this service had been available four years ago!!!

It was all clear and concise…

It was all clear and concise instructions. You could leave the site at anytime and all your work is saved so you can go back to where you left off. The only negative I feel is that it doesn’t tell you until the end that you have to pay more money which was abit of a shock so maybe you could just make your applicants aware that it isn’t just £399. Thankyou though still as it only took 3 weeks to get the probate done and to become the administrator of my mums estate.
